BELOW ARE GENERAL TERMS AND CONDITIONS. IF ANY ADDITIONAL TERMS OR CONDITION APPLY TO A GIVEN AUCTION THEY WILL BE LISTED AND CONFIRMED ON THE FRONT PAGE OF EACH INDIVIDUAL ONLINE AUCTION. In particular, REAL ESTATE auctions will have extensive specific terms & conditions and disclosures that are specific to that Particular auction and that specific property, and the Auction Details page for that property will be your best source of terms for REAL ESTATE Auctions.
Terms: The Buyer's Premium, if any, that is applicable to that auction will be clearly noted in the Auction Details for that particular auction. Be sure to take note of it before bidding. Forms of payment accepted will be noted there as well. Sales tax will be noted here as well.
All personal property items are purchased AS-IS, WHERE-IS with NO WARRANTY expressed or implied. Descriptions are believed to be accurate, but are not guaranteed. Please ask all the questions you need answered to determine the condition and suitability of the items for your purposes well in advance of the closing date of the auction. You are bidding only on the described item, not necessarily everything seen in the photo(s). For example, a cabinet or bookshelf may have items on it when photographed; read the description to find out what items are included. Feel free to call or email with any questions. PLEASE KNOW WHAT YOU ARE BIDDING ON BEFORE BIDDING!
After the auction is over you will receive an invoice via your registered email. If you do not receive an invoice by 9:00am of the next day, please check your spam folder, and if you don't see it there contact Mark at firstname.lastname@example.org .
IF YOU DO NOT PAY FOR AND PICK UP YOUR ITEM(S) ON THE ALLOTTED DAY AND TIME, YOU ARE STILL RESPONSIBLE TO PAY FOR THE ITEMS IN FULL. YOUR CREDIT CARD ON FILE WILL BE CHARGED FOR THE FULL AMOUNT INCLUDING BUYER"S PREMIUM AND SALES TAX (if applicable). THE ITEMS WILL BE CONSIDERED ABANDONED AND WILL BE DISPOSED OF AT THE AUCTIONEER’S DISCRETION. If payment in full is not received on time, all bidding by the non-paying bidder will be suspended and any existing bids on other auctions will be deleted until items are paid in full. A $25 reinstatement fee will apply. The Auctioneer reserves the right to pursue any and all additional remedies.
Some auctions may have shipping offered, but many will not. See the Auction Details page of the auction you are interested in to see if shipping is offered and on what terms. Buyers are responsible for all shipping costs when shipping is offered.
Be sure to review your bid carefully before placing them. ALL BIDS ARE FINAL, IRREVOCABLE, AND BINDING. Bids cannot be retracted once placed. NO refunds or guarantees are offered. NO charge-backs will be accepted, and by bidding you agree to immediately reimburse Auctioneer for both the original bid price plus Buyer’s Premium (and shipping costs if applicable) AND any additional costs arising from any dispute or charge-back filed by you with your credit card company.
Dynamic "Soft" closing/Staggered closing.
The online auction closes a certain number of item(s) every minute. This feature will close the bidding in intervals. This feature works with the auto-extend feature to emulate a 'live' auction; if an item receives a bid within 5 minutes of ending the item will be extended 5 additional minutes. (10 minutes for Real Estate auctions)
Bid Notifications & Invoices:
If you have been outbid you will be notified by email. Invoices will be sent by email ONLY (you are responsible for checking your email). If you believe that you have won an item and have not received an email you must notify us by email or Mark at (614)218-1318 immediately.
Title: Title of auction items transfers from seller to buyer when payment in full has been made and cleared.

IMPORTANT: The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchaser, items not paid for and/or removed within the specified time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.
The auctioneer reserves the right to add or remove items from the auction, to split or combine lots, to add minimum bids or reserve prices, to cancel, suspend, extend or reschedule an individual item and or auction event and to make changes to the auction closing times or inspection or removal times.
Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Franklin County Ohio. Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.
Individual auctions will have applicable terms and conditions that apply to that auction. All individual terms and conditions noted in the Auction Details for that auction supersede 'General' terms and conditions. Therefore all general terms and conditions apply unless the 'individual' terms and condition conflict, in which case the individual terms and conditions apply. Final terms and conditions cannot be altered except in writing by the Auctioneer.
